The Amazingly Industrious Trademark Mogul Wayne GrayWayne Gray is known for having filed an application to trademark "INUX" in 1999 and becoming engaged in a lengthy dispute with X/Open over conflicts with the legitimacy of the trademark "UNIX". Gray is also know for having recently filed a lawsuit against Novell, SCO, and X/Open, accusing them of racketeering and fraud. Wayne has been extremely industrious at trademarking new products and services. A perusal of the USPTO trademark database shows that he has filed no less that 10 applications for trademarks. Amazingly, two of those are now actually registered! Let us check out his stable: INUX: Filed Aprl 29, 1999. "Computer operating system software for use in consumer hardware systems." Currently disputed by X/Open IGUANX: Application: April 29, 1999 "Computer hardware system, consisting of computer hardware and computer software, namely operating system software, computer game loading software utilities specifically designed for computer game play, software for providing access to the global computer network, and software for providing telephony capabilities through use of the global computer network; computer telephony hardware for providing telephony capabilities through use of the global computer network." First use: Dec. 6, 1999. First use in commerce: Apr. 24, 2000. Registered!!! TELINUX: Application Oct 31, 1999: "Computer software for use in facilitating access to global computer network information and communications services." Abandoned. TELEBAHN: Application date Oct 31, 1999. "Information and communication services over a global computer network, namely the management of communication interconnect information betwee two or more network users" First use: Dec 5, 1999. First use in commerce: Feb 12, 2000. Registered!!! BIZ2BIZ: Application Dec 21, 1999. "Graphical computer software Internet web site guide organized by categories." Abandoned. IFAVS: Application Dec 21, 1999. "Graphical computer software Internet web site guid organized by categories." Abandoned. UPS2NOW: Application Dec 21, 1999. "Sofware Upgrade Service". Abandoned. INTRAPORTS: Application Jan 7, 2001. "Computer software enabling a plurality of individually addressable virtual computer environments within one computer." Abandoned. INTERPORTS: Application Jan 7, 2001. "Computer software enabling a plurality of individually addressable virtual computer environments within one computer." Abandoned. UNITEDINUX: Application: July 1, 2002. "Computer software for use in the management of business enterprise communications across a global computer network" First use: Apr. 10, 2003. First use in commerce: Oct. 16, 2003. The examiner refused the trademark as confusing with Linux. Abandoned. The domains "www.telebahn.com" and "www.iguanx.com" both resolve to "www.inux.net". Curiously, in his complaint against SCO-Novell-X/Open, http://ttabvue.uspto.gov/ttabvue/ttabvue-91122524-OPP-73.pdf, Gray states: "... X/Open filed a[] ... trademark Notice of Opposition ... on April 11, 2001 ..." "... Gray suspend iNUX business activities after receipt of X/Open's opposition complaint ..." "... ultimately X/Open delayed the matter for eight months ... finally forcing Gray, a person of limited means, to continue business suspension and proceed with the opposition suit ..." Yes, Gray's business of filing bogus trademark applications did slow down after April 11, 2001, but he was still able to file the "UNITEDINUX" application after that date, including entry into commerce on Apr. 10, 2003. Gray is from Tampa, Florida. Curiously, even though BSF has several offices in that state, it does not have one in Tampa. I see a big opportunty for BSF in the future. |
