To The Board of Directors of Overstock.com

It is my understanding that Overstock.com is releasing an earnings report on February 5, 2007 and the company will file a report with the Securities and Exchange Commission on that date.

I respectfully submit the following questions:

Has the Board of Directors considered any additional disclosure relating to the SEC subpoena of Overstock.com?
Has the Board of Directors considered any disclosure or had any discussion as to the activities of Judd Bagley relating to his “investigative" work while Director of Social Media of Overstock.com?
Has the Board of Directors had any discussion as to Judd Bagley’s activities relating to his work at the web site antisocialmedia.net?
Has there been any discussion by the Board of Directors relating to any communication made by Patrick Byrne or Judd Bagley on internet message boards or internet blogs or any other media?
Has the Board of Directors reviewed any and all communications by Patrick Byrne or Judd Bagley on internet message boards, internet blogs, and other media?
Has any consideration been given to any required disclosure by Overstock.com relating to the communications made by either Patrick Byrne or Judd Bagley on internet message boards, blogs, or any other media?
Does the Board of Directors individually and collectively support the possible use of anonymous aliases by employees of Overstock.com (either acting as Overstock.com employees or individuals) on either internet message boards or blogs when such communications relate to Overstock.com and/or its officers?
Does the Board of Directors of Overstock.com individually and collectively support the activities of Judd Bagley related to his activities regarding the web site antisocialmedia.net?
Has the Board of Directors reviewed the activities of Patrick Byrne and Judd Bagley on internet message boards, internet blogs, and other media?
Has the Board of Directors reviewed all the activities of Judd Bagley on the web site antisocialmedia.net?
Has the Board of Directors reviewed any possible relationship between the activities of antisocialmedia.net, Patrick Byrne, and Overstock.com?
Does the Board of Directors keep transcripts of all discussions of the above if any such discussions were made?
